1. Legal Entity and Acceptance of Terms Neurapulse is a product owned by Impirica Inc. By accessing and using the Neurapulse web-based application ("App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the App.
2. Purpose of the App The App is designed to administer a cognitive task to assess your fitness for safety-sensitive positions. By using this App, you consent to participate in this assessment.
3. Test Taker Confirmation By completing the test, you confirm that you are the intended test taker as requested by your employer or potential employer, and that you are legally able to participate in this assessment.
4. User Eligibility You confirm that you are using this App at the request of your employer or potential employer, and that you are legally able to participate in this assessment.
5. Test Integrity You agree to complete the cognitive task honestly and to the best of your ability. Any attempt to manipulate the results or cheat will be considered a violation of these Terms.
6. Data Collection and Use By using the App, you consent to the collection and processing of your test results and related data. This data will be shared with the manager who initiated your test. We process your data based on your consent, which you can withdraw at any time. You have the right to access, rectify, erase, restrict processing, and to data portability. You can exercise these rights by contacting our Data Protection Officer at privacy@neurapulse.com.
7. Privacy Your privacy is important. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.
8. No Guarantee of Employment Completion of this test does not guarantee employment or continued employment. The test results are one of many factors that may be considered in employment decisions.
9. Limitation of Liability Impirica Inc. is not responsible for any employment decisions made based on the results of this test. We do not guarantee the accuracy or reliability of the test results.
10. Intellectual Property All content in the App, including but not limited to the test itself, graphics, and software, is the property of Impirica Inc. and protected by intellectual property laws.
11. Prohibited Actions You agree not to: a) Attempt to reverse engineer, decompile, or disassemble the App b) Use the App for any unlawful purpose c) Share your unique test link with others d) Record, copy, or distribute any part of the test.
12. Termination Impirica Inc. reserves the right to terminate your access to the App at any time, for any reason, without notice.
13. Changes to Terms Impirica Inc. may modify these Terms at any time. Your continued use of the App after any changes indicates your acceptance of the modified Terms.
14. Governing Law These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.
15. Data Security We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk of processing personal data. In the event of a data breach, we will notify affected individuals, and the appropriate regulators as required by legislation.
16. International Data Transfers If we transfer personal data outside Canada, we will ensure that appropriate safeguards are in place to protect the data in accordance with applicable regulations.
